Federal Judge Mandates Freedom of Abrego Garcia from ICE Detention
A federal judge has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous removal to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her decision, the judge noted that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
Context of the Legal Challenge
The legal challenge center on disputed assertions. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate criminal case in the state of Tennessee.
Conditions of Freedom
The judge, who was hearing his petition to removal in a Maryland district court, ruled that he must now adhere to the conditions of his release from jail in Tennessee. This order shifts his monitoring to the jurisdiction handling his criminal case.
This decision represents a significant turn in a complicated legal case featuring claims of wrongful detention and contested gang associations.
